These Terms of Service ("Terms") govern your access to and use of the SFR Analytics MCP service ("Service") provided by SFR Analytics, Inc. ("SFR Analytics," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Service Description
The Service provides a Model Context Protocol (MCP) server that enables AI assistants and development tools to access single-family residential property data, rental analytics, buyer intelligence, and private lending insights via structured tool calls.
2. Account and Access
- You must create an account or obtain API credentials to use the Service.
- You may authenticate via OAuth 2.0 (for Claude and other MCP clients) or API keys (for programmatic access).
- You are responsible for maintaining the security of your account credentials and API keys.
- You must not share, publish, or expose your API keys in client-side code, public repositories, or other insecure locations.
- You must promptly notify us if you become aware of any unauthorized use of your account.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to violate any applicable law or regulation, including fair housing, fair lending, and privacy laws
- Attempt to gain unauthorized access to the Service, other accounts, or related systems
- Use the Service for automated bulk data collection, scraping, or redistribution of data
- Resell, sublicense, or redistribute the data obtained through the Service without prior written consent
- Use the data for discriminatory purposes, including unlawful discrimination in housing, lending, or employment
- Interfere with or disrupt the Service or impose an unreasonable load on our infrastructure
- Reverse engineer, decompile, or attempt to extract the source code of the Service
4. Subscription Plans and Billing
- Access to the Service requires an active subscription plan.
- Plan features, pricing, and rate limits are described on our website and may change with notice.
- Subscriptions renew automatically unless cancelled before the renewal date.
- We may suspend or limit access if your account is past due or in violation of these Terms.
5. Rate Limits and Fair Use
- The Service enforces rate limits based on your subscription tier.
- Exceeding rate limits may result in temporary throttling or request rejection.
- Sustained abuse of rate limits or attempts to circumvent them may result in account suspension.
6. Data and Intellectual Property
- The data provided through the Service is sourced from public records, licensed data providers, and commercial data vendors.
- We grant you a limited, non-exclusive, non-transferable license to use the data for your internal business purposes in accordance with your subscription plan.
- All intellectual property rights in the Service, including software, documentation, and data compilations, remain with SFR Analytics and its licensors.
- You retain ownership of any content you upload to the Service (e.g., lending criteria documents).
7. Third-Party AI Clients
The Service is designed to be used through third-party AI assistants (Claude, Cursor, etc.). When you use the Service through these tools:
- Tool calls from your authenticated AI client are treated the same as direct API calls from you.
- You are responsible for the actions taken by AI clients on your behalf.
- We are not responsible for how third-party AI clients process, cache, or display the data returned by the Service.
8. Disclaimers
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
- We do not warrant that the data is complete, accurate, or current. Property records, rental estimates, and lending data may contain errors or omissions.
- The Service does not provide legal, financial, investment, or real estate advice. You should independently verify data before making business decisions.
- We do not guarantee uninterrupted or error-free operation of the Service.
9. Limitation of Liability
To the maximum extent permitted by law, SFR Analytics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use of or inability to use the Service
- Any errors or omissions in the data provided
- Unauthorized access to or alteration of your data
- Any third-party conduct on the Service
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless SFR Analytics and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.
11. Termination
- You may terminate your account at any time by contacting us.
- We may suspend or terminate your access at any time for violation of these Terms, with or without notice.
- Upon termination, your right to use the Service ceases immediately. Sections 6, 8, 9, 10, and 13 survive termination.
12. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes by updating the "Last Updated" date and, for significant changes, by email or in-product notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.
